1. About these terms
These Terms of Use govern your use of the Mindwork Studio app, website, account, and related services (collectively, the “Service”). The Service is operated by Selvan Studio LLC, a California limited liability company (“Selvan Studio,” “we,” “us,” or “our”).
Your license to the iOS and iPadOS app is governed by the Apple Standard End User License Agreement. These Terms govern your Mindwork Studio account and use of the Service. If these Terms conflict with the Standard EULA about the license to the app, the Standard EULA controls for that issue.
Our Privacy Policy explains how we handle personal information. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and accounts
Mindwork Studio is intended for people aged 16 and older. You must be legally able to agree to these Terms where you live. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who has reviewed these Terms. If applicable law does not permit you to agree to these Terms, do not use the Service.
You are responsible for the activity on your account and for keeping your sign-in credentials secure. Contact us promptly if you believe someone has accessed your account without permission.
3. Your content and AI-assisted creation
You retain your rights in the prompts, scripts, and other content you provide (“Your Content”). You give us a limited permission to host, process, reproduce, and transmit Your Content only as needed to operate, secure, and support the Service, including through the service providers described in the Privacy Policy. This permission ends when Your Content is deleted, except for copies retained in backups or as needed for legal, security, or deletion-request handling as described in the Privacy Policy.
You represent that you have the rights and permissions needed to provide Your Content and to allow us to process it for these purposes. Do not submit another person’s confidential or personal information unless you have authority to do so.
As between you and Selvan Studio, we do not claim ownership of scripts or audio generated for you through the Service. Subject to these Terms and applicable law, you may use, edit, save, export, and share that material.
AI-generated scripts and audio are tools for your review and editing. Results may be incomplete, inaccurate, unsuitable for your circumstances, or similar to material generated for someone else. We do not guarantee that generated material is unique, qualifies for intellectual-property protection, or is free of third-party rights. You are responsible for reviewing content before relying on, saving, exporting, or sharing it.
4. Acceptable use
You may not use Mindwork Studio to:
- break the law or violate another person’s rights;
- create or distribute content that facilitates harm or abuse;
- interfere with, overload, probe, or bypass the service’s security;
- access another person’s account or content without permission; or
- resell or exploit the service except with our written permission.
The app may reject or limit requests when needed for safety, security, legal compliance, or service integrity.
5. Wellness and safety
Mindwork Studio supports personal guided mental work. It is not a medical service, a substitute for professional care, or an emergency or crisis service. It does not diagnose or treat any condition. If you or someone else may be in immediate danger, contact local emergency services or an appropriate crisis resource.
6. Subscriptions and billing
Optional monthly and annual subscriptions are offered through Apple. The purchase screen shows the current plan, duration, benefits, trial eligibility, and full renewal price before you subscribe. Subscriptions renew automatically until canceled through your Apple account. Apple processes payments, renewals, cancellations, and eligible refunds under its terms.
Each paid plan currently includes conversion of up to 35,000 characters into narrated audio during each subscription month. Unused allowance does not roll over. If Apple shows that you are eligible for the introductory trial, the trial includes up to 5,000 characters and that use counts toward your first month’s allowance.
Deleting your Mindwork Studio account does not cancel an Apple subscription. You must cancel it separately through Apple if you do not want it to renew. When access ends, you can continue to use manually authored features and listen to existing audio, while new AI writing and audio generation may require an active subscription.
7. Ownership of the service
Mindwork Studio, its software, design, branding, and service content are owned by Selvan Studio or its licensors. Except for the limited app license supplied under Apple’s Standard EULA, these terms do not transfer any ownership interest to you.
8. Third-party services
The Service relies on or may link to third-party services, including Apple services used for app distribution, sign-in, and subscriptions. Your use of a third-party service may be subject to that provider’s terms. Except where applicable law requires otherwise, Selvan Studio is not responsible for third-party services that it does not control.
9. Availability and changes
We may update, add, remove, suspend, or discontinue parts of the service. We do not promise that every feature will always be available or free from interruption or error. We will provide notice when required by applicable law or when a material change affects an active subscription.
10. Suspension and termination
You may stop using Mindwork Studio and request account deletion in the app. We may limit or suspend access when reasonably necessary to address a serious or repeated violation of these terms, protect users or the service, or comply with law. Account suspension or deletion does not itself cancel billing managed by Apple.
11. Disclaimers and legal rights
To the extent permitted by law, the service is provided “as is” and “as available.” We do not guarantee that generated content will achieve a particular result. Nothing in these terms excludes or limits rights, warranties, or remedies that cannot lawfully be excluded or limited where you live. Apple’s Standard EULA contains additional warranty and liability terms for the licensed app.
12. Governing law and general terms
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent that the mandatory laws of where you live apply. You and Selvan Studio consent to the jurisdiction of state and federal courts in California, except where applicable law gives you the right to bring a claim elsewhere. Nothing in these Terms limits non-waivable consumer rights or remedies.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, or sale of all or part of our business, or as otherwise permitted by law.
These Terms, together with the Apple Standard EULA, are the entire agreement between you and Selvan Studio concerning the Service and replace prior agreements or understandings about the same subject.
13. Changes to these terms
We may update these terms as the service changes. The published version will show its effective date, and we will provide additional notice when required. Continuing to use the service after revised terms take effect means you accept the revised terms.
